Terms of Service
Version 1.0 — Effective July 19, 2026
These Terms of Service (ToS) govern access to and use of the DriveShare platform, a peer-to-peer car rental service operated by DriveShare SAS. By creating an account, the user acknowledges having read and accepted them.
1. Purpose and definitions
DriveShare is a platform connecting vehicle owners ("Owners"), renters ("Renters") and partner garages providing vehicle certification and inspection. DriveShare acts as a technical intermediary and is neither the owner nor the lessor of the vehicles listed.
2. Registration and roles
Registration is open to any adult individual. A single account may combine the Renter and Owner roles. Garage accounts follow a dedicated registration flow. Users undertake to provide accurate information and keep it up to date.
3. Identity and driving licence verification
Before any booking, the Renter must verify their identity (KYC) and driving licence through our verification provider (Stripe Identity). No booking can be confirmed until both verifications are approved.
4. Booking and confirmation
Bookings are made online subject to the displayed availability. A booking becomes firm once confirmed and payment is authorised. DriveShare computes the total price including the rental fee, the service fee and applicable VAT.
5. Vehicle state reports (EDL)
A contradictory departure and return inspection is carried out and signed by both parties. Signing the departure report starts the rental; signing the return report, absent any discrepancy, closes it. Photos and mileage readings are authoritative between the parties.
6. Obligations of the parties
The Owner warrants that the vehicle is insured, maintained and compliant with regulations. The Renter undertakes to use the vehicle with due care, to comply with road traffic rules and to return it in the condition recorded at departure.
7. Reviews and ratings
After the rental, each party may post a review. Cross-reviews remain hidden until both parties have submitted theirs or the applicable window expires, ensuring their sincerity. Reviews breaching the charter may be moderated.
8. Cancellation and termination
Cancellation and refund terms are detailed in the Sales Terms. DriveShare reserves the right to suspend or terminate an account in the event of a serious breach of these ToS.
9. Liability
DriveShare provides an intermediation service and cannot be held liable for damage arising from the direct relationship between Owner and Renter, subject to mandatory legal provisions. Disputes about the vehicle's condition are handled through the platform's dispute resolution process.
10. Governing law and disputes
These ToS are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts shall have jurisdiction.
